Buyer understands that deposits are non-refundable, but may be transferred to a future litter at the Seller’s discretion.

3. Health Guarantee (Louisiana Pet Lemon Law)

  • Seller guarantees that the puppy is healthy at the time of sale and has received age-appropriate veterinary care.

  • Buyer must have the puppy examined by a licensed veterinarian within 72 hours of pickup/delivery.

  • If the puppy is diagnosed with a life-threatening genetic or congenital defect existing prior to sale, Buyer may:

    • Return the puppy for a full refund, or

    • Exchange for another puppy of equal value (when available).

  • Minor treatable issues (parasites, ear infections, coccidia, giardia, skin conditions, etc.) are not covered.

  • Seller is not responsible for veterinary expenses incurred after the puppy leaves Seller’s possession.

4. Genetic Health Guarantee

  • Seller guarantees the puppy against life-threatening genetic conditions for up to 24 months from the date of birth.

  • If a hereditary defect is diagnosed and verified in writing by two licensed veterinarians, Buyer may:

    • Return the dog for a replacement puppy of equal value, or

    • Retain the dog and receive a partial refund (amount determined at Seller’s discretion).

  • Conditions caused by poor nutrition, neglect, or injury are not covered.

5. Breeding Rights

  • This puppy is sold with FULL BREEDING RIGHTS through the AKC/CKC (or applicable registry).

  • Buyer agrees:

    • To register the puppy under their name with the proper kennel club.

    • To follow ethical and responsible breeding practices, including:

      • Breeding only after appropriate health testing and maturity.

      • Avoiding inbreeding or crossbreeding with unregistered dogs.

      • Providing proper prenatal and neonatal care for all litters.

    • Not to sell or place offspring with puppy mills, brokers, or pet stores.

    • To maintain accurate records of all litters and sales.

  • Seller reserves the right to revoke breeding rights if unethical breeding is suspected or contract terms are breached.

6. Ownership Type

Full Ownership — Buyer receives full legal and breeding rights to the puppy upon completion of sale.

Co-Ownership — Seller retains partial rights to the puppy as outlined below.

CO-OWNERSHIP ADDENDUM (if applicable)

6A. Purpose of Co-Ownership

Co-ownership is designed to:

  • Allow Seller to retain breeding rights or “pick of the litter” options.

  • Ensure the puppy contributes to an ethical, responsible breeding program.

  • Protect the dog from misuse or unethical breeding.

6B. Terms of Co-Ownership

  • Seller retains shared registration with AKC/CKC (or applicable registry).

  • Seller has rights to:

    • Approve all breeding pairings.

    • Use the dog as a stud (if male) for up to ___ litters per year.

    • Receive first pick puppy or a stud fee of $__________ per litter, if agreed.

  • Buyer is responsible for:

    • Daily care, health, housing, and training of the dog.

    • Maintaining up-to-date veterinary care and health testing.

  • Both parties agree to:

    • Keep open communication regarding the dog’s health and breeding.

    • Not breed the dog without mutual consent.

6C. Termination of Co-Ownership

  • Co-ownership may be terminated if:

    • The Buyer wishes to buy out the Seller’s remaining breeding rights for $__________.

    • The Buyer breaches contract terms.

    • Both parties agree in writing.

  • Upon termination, registration will be transferred fully to the Buyer or revert to Seller as outlined in a signed addendum.

7. Buyer Responsibilities

  • Provide proper food, shelter, and veterinary care.

  • Keep the dog in a safe, loving, indoor environment.

  • Maintain heartworm prevention, vaccinations, and routine care.

  • Follow ethical breeding guidelines and ensure offspring are placed responsibly.

  • Never surrender the dog to a shelter or resell without Seller’s written consent.

8. Rehoming Policy

  • If Buyer is unable to keep the dog, Seller must be notified first.

  • The dog may not be surrendered to a shelter, rescue, or resold without written consent.

  • Seller reserves the right to reclaim the dog in cases of neglect, unethical breeding, or breach of contract.

9. Breach of Breeding Agreement

  • If Buyer breeds this dog irresponsibly or violates contract terms:

    • Seller may revoke breeding rights.

    • Seller may reclaim the dog without refund.

    • Legal action may be taken to enforce this agreement.

  • Violations include but are not limited to:

    • Breeding before health testing or maturity.

    • Selling offspring to mills, brokers, or pet stores.

    • Crossbreeding without prior agreement.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Louisiana.
Any disputes shall be handled in the parish court of the Seller’s residence.

  

11. Entire Agreement

This document represents the entire Agreement between Seller and Buyer.
Any amendments must be in writing and signed by both parties.
